These Terms of Service ("Terms") govern your use of the Woosh Vote mobile application and website (collectively, the "Service"), operated by Pistons & Ink LLC ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

Woosh Vote allows users to create, share, and vote in photo-based contests ("Battles"). You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

2. Your Account

You provide your first name and email address to use the Service. You are responsible for keeping your contest dashboard link secure. We are not responsible for activity that occurs under your account due to your failure to keep access information private.

3. User Content

You retain ownership of photos and content you upload ("User Content"). By uploading User Content, you grant Woosh Vote a worldwide, non-exclusive, royalty-free license to store, display, and distribute your content solely for the purpose of operating the Service.

You agree not to upload content that:

• Infringes on the intellectual property rights of others.
• Is obscene, offensive, defamatory, or illegal.
• Contains personal information of others without their consent.
• Is used to harass, bully, or harm others.

We reserve the right to remove any content that violates these Terms.

4. Subscription Plans and Payments

Woosh Vote offers free and paid subscription plans. Payments for paid plans are processed securely by Stripe. Subscription fees are billed in advance on a monthly or annual basis. Refunds are handled on a case-by-case basis — contact us at support@wooshvote.com.

5. Prohibited Activities

You may not use the Service to:

• Manipulate votes through automated means, bots, or fraudulent activity.
• Reverse-engineer, copy, or exploit any part of the Service.
• Interfere with the security or integrity of the Service.
• Use the Service for any unlawful purpose.

6. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Pistons & Ink LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
